ÖZET
Hasta hakları kavramı literatüre 1980'li yıllarda girmiş, 1990 yıllarda gelişerek, bilimsel tartışma ve bildirilere konu olmuş, 2000'li yıllarda ise sağlık işletmelerinde/kurumlarında uygulanmaya başlanarak hukuki bir alt yapı kazanmış, 2010'lu yıllarda kurumsal bir yapı haline dönüşmüştür. Bu çalışmanın amacı, son dönemde gerçekleşen kamu hastane birlik yapılanması ve hasta hakları kurul yapılanmasındaki değişimin hasta hakları kurul kararları üzerine etkisini araştırmaktır. Araştırmada bir ildeki 2012-2015 yılları arasında hasta hakları kurullarının hasta şikayetlerine bağlı olarak aldığı kararlarının içerik analizi yapılmaktadır. Veriler çapraz tablo tekniği ile işlenmiş ve yıllar arasındaki farklılaşma Pearson Chi-Square testi ile izlenmeye çalışılmıştır. Hasta şikayetlerinin nedenleri incelendiğinde, yarısı hizmetten faydalanma hakkı ile ilgili olup, saygı görme, tıbbi özen ve bilgilendirme ile ilgili sorunlar bütün yıllarda ön plana çıkmaktadır. Şikayet edilen personelin yaklaşık yarısını istikrarlı bir şekilde hekimler ve onda birini ise hemşireler oluşturmaktadır. Son yılda diş hekimlerinin şikayet edilmesinde anlamlı bir artış gözlenirken, tıbbi sekreter, temizlikçi, güvenlikçi ve idari personel şikayetlerinde anlamlı bir azalma gözlenmektedir. Elde edilen bulgulara göre; kamu hastane birlik yapılanmasının hastaların yazılı şikayetlerini azaltmış ve yerinde çözüm uygulamalarını güçlendirmiştir. Hasta hakları kurullarının sağlık müdürlükleri bünyesinde birleştirilmesi ve üye yapısının değiştirilmesi de kararların daha profesyonelce ve objektif alınmasına katkı sağlamıştır. Sonuç olarak, sistem ve hastalar tarafından kanıksanmış olan mahremiyet ihlalleri insani değerleri, bilgilendirilme eksikliği tedavi etkinliğini, nöbet usulü çalışma düzeni çalışanlarında tükenmişliği, tıbbi bakımda ise 'özensizliği' tetiklemektedir. Sağlık yöneticileri ve eğitimciler bu sorunlarla yakından ilgilenmelidirler.

ABSTRACT
The concept of patient rights, 1980s went into the literature, developed in 1990, and began to be implemented in health institutions in the 2000s. Thus, a legal infrastructure has gained, institutionalized in 2010 years. The purpose of this study is to investigate patient rights violations through the decisions of the patient rights board, taking into account the change in board structure and public hospital union structuring. The survey was conducted on board decisions taken in 2012-2015. The data were processed with cross-table technique and the difference between the years was tried to be monitored by Pearson Chi-square test. Public hospital union structure has reduced written complaints of patients and strengthened on-site solutions. When the causes of patient complaints are examined, half is concerned with the right to benefit from the service, and issues of respect, medical care and information are at the forefront. Approximately half of the complaints are consisted of physicians and one in ten nurses. Significant reductions have been observed in complaints of medical secretaries, cleaners, security personnel and administrative staff when there has been a significant increase in complaints of dentists in the last year. According to findings; the integration of patient rights boards within the health directorates and the change of member structure contributed to making decisions more professionally and objectively. As a result, patient privacy violations that have been acknowledged by the system and the patients, is destroying human values. Lack of patient information reduces treatment effectiveness. Health worker's seizure-prone work are increasing their exhaustion and triggers insecurity in medical care. Health administrators and educators should be very interested in these issues.

1. TERMS OF USE

The "Terms of Use" hereby is also a part of the any "USER Contract" was and/or will be done with the users using "Turkiye Klinikleri" services with or without a fee an inseparable.

2. DEFINITIONS

2.1. "SITE": A website offering different kind of services and context with a certain frame determined by "Turkiye Klinikleri" and it is accessible on-line on http://www.turkiyeklinikleri.com domain name and/or subdomains connected to the domain name.

2.2. USER: A natural person or a legal identity accessing to the "SITE" through online settings.

2.3. LINK: A link enabling to access to another website through the "SITE", the files, the context or through another website to the "SITE", the files and the context.

- Providing scientific articles, books and informative publications for health industry.

- Providing structural, statistical and editorial support to article preparation stage for scientific journals.

4. GENERAL PROVISIONS

4.1. "Turkiye Klinikleri" is completely free to determine which of the services and contents provided in the "SITE" will be charged.

4.2. People benefiting from the services provided by "Turkiye Klinikleri" and using the website can use the "SITE" only according to the law and only for personal reasons. Users have the criminal and civil liability for every process and action they take in the "SITE". Every USER agrees, declares and undertakes that they will not proceed by any function or action infringement of rights of "Turkiye Klinikleri"s and/or other third parties', they are the exclusive right holder on usage, processing, storage, made public and revealing any written, visual or auditory information reported to Turkiye Klinikleri" and/or "SITE" to the third parties. "USER"s have to make the changes and/or corrections "Turkiye Klinikleri" required immediately. Any changes and/or corrections that are required by "Turkiye Klinikleri", may be made by "Turkiye Klinikleri" when needed. Any harm, criminal and civil liability resulted or will result from changes and/or corrections required by "Turkiye Klinikleri" and were not made on time by the "USER"s belongs completely to the users.

4.8. "Turkiye Klinikleri" may give links through the "SITE" to other websites and/or "CONTEXT"s and/or folders that are outside of their control and owned and run by third parties. These links are provided for ease of reference only and do not hold qualification for support the respective web SITE or the admin or declaration or guarantee for the information inside. Being late or failure of performance or non-defaulting of this and similar cases like this will not be the case from the viewpoint of "Turkiye Klinikleri", and "Turkiye Klinikleri" will not have any damage liability for these situations. "Force majeure" term will be regarded as outside of the concerned party's reasonable control and any situation that "Turkiye Klinikleri" cannot prevent even though it shows due diligence. Also, force majeure situations include but not limited to natural disasters, rebellion, war, strike, communication problems, infrastructure and internet failure, power cut and bad weather conditions.

8. LAW AND AUTHORISATION TO FOLLOW

Turkish Law will be applied in practicing, interpreting the hereby "Terms of Use" and managing the emerging legal relationships within this "Terms of Use" in case of finding element of foreignness, except for the rules of Turkish conflict of laws. Ankara Courts and Enforcement Offices are entitled in any controversy happened or may happen due to hereby contract.

9. CLOSING AND AGREEMENT

Hereby "Terms of Use" come into force when announced in the "SITE" by "Turkiye Klinikleri". The users are regarded to agree to hereby contract terms by using the "SITE". "Turkiye Klinikleri" may change the contract terms and the changes will be come into force by specifying the version number and the date of change on time it is published in the "SITE".
